Effective date: October 10, 2026
1. Acceptance and Scope
These Terms of Service govern access to and use of the Trouvaillesys WhatsApp notification service and related messaging, integration, support, and administration services (the "Service"). The organization or person ordering or using the Service is the "Client." By ordering, accessing, or using the Service, the Client agrees to these Terms and the applicable order, proposal, subscription, or service description.
The Service is intended for lawful business use. Anyone accepting these Terms for an organization represents that they have authority to bind that organization.
2. Trouvaillesys WhatsApp Notification Service
The Service enables Clients to send and manage permitted notifications and communications through the WhatsApp Business Platform. Depending on the agreed configuration, the Service may include message-template setup, API or webhook integration, notification routing, delivery-status reporting, operational support, and related administration.
WhatsApp and Meta operate the underlying platform and may change platform features, availability, eligibility, pricing, message categories, technical requirements, or policies independently of Trouvaillesys.
3. Client Responsibility for Customer Consent and Opt-In
The Client is solely responsible for obtaining, documenting, and maintaining every consent, opt-in, notice, and other lawful basis required before sending a WhatsApp message or providing customer data to the Service.
- Each opt-in must clearly identify the Client's business and the types or purposes of messages the customer agrees to receive.
- The Client must retain sufficient records to demonstrate when, where, and how consent was obtained.
- The Client must promptly honor opt-out, withdrawal, blocking, deletion, and communication-preference requests.
- The Client must not use purchased, scraped, rented, or unlawfully obtained contact lists.
- The Client is responsible for ensuring that its notices and consent flows comply with applicable law and WhatsApp requirements.
Trouvaillesys may request evidence of consent or opt-in and may refuse or suspend messaging when that evidence is insufficient.
4. Acceptable Messaging
The Client must send only lawful, accurate, relevant, and expected messages to recipients who are eligible to receive them. The Client must not use the Service to:
- send spam, unsolicited messages, deceptive promotions, or misleading content;
- harass, threaten, exploit, discriminate against, or impersonate any person or organization;
- distribute malware, phishing content, fraudulent offers, or content that compromises privacy or security;
- promote illegal products, services, transactions, or activities;
- send content prohibited or restricted by WhatsApp, Meta, telecommunications providers, or applicable law; or
- interfere with the platform, evade enforcement, manipulate quality signals, or use unauthorized automation.
The Client is responsible for all message content, recipient lists, campaign decisions, and actions taken through its account.
5. WhatsApp and Meta Policies
The Client must comply at all times with the then-current WhatsApp and Meta terms, policies, technical documentation, and review requirements that apply to the Service, including the WhatsApp Business Messaging Policy, WhatsApp Business Terms of Service, applicable commerce policies, and Meta platform terms.
These third-party requirements are incorporated into these Terms to the extent they apply. If a Client instruction conflicts with a WhatsApp or Meta requirement, Trouvaillesys may reject the instruction or take corrective action needed to protect the Service and connected accounts.
6. Service Charges
The Client must pay Trouvaillesys service, setup, integration, support, subscription, usage, and other fees stated in the applicable order, proposal, invoice, or plan. Unless otherwise agreed in writing:
- fees are exclusive of applicable taxes, duties, and government charges;
- invoices are payable by the due date shown on the invoice;
- additional work outside the agreed scope may require additional charges; and
- overdue or unpaid amounts may result in restricted access or suspension.
Trouvaillesys may change recurring service charges by giving reasonable notice before the change applies to a future billing period.
7. WhatsApp Messaging Charges
Meta or WhatsApp may charge for messages according to message category, destination, volume, delivery, conversation type, or other pricing rules. These messaging charges are separate from Trouvaillesys service charges unless an order expressly states otherwise.
The Client is responsible for all applicable WhatsApp or Meta messaging charges, carrier costs, taxes, and third-party fees generated through the Client's account or instructions. Pricing and message categorization may change under Meta's rules. Trouvaillesys may pass through such charges and reasonable associated costs.
8. Templates and Message Restrictions
Business-initiated messages may require a WhatsApp-approved message template and must use the approved content, language, category, and variables. The Client acknowledges that:
- Meta or WhatsApp may approve, reject, reclassify, pause, disable, or require changes to a template;
- messages may be subject to customer-service windows, frequency limits, quality ratings, recipient feedback, country restrictions, and account-level messaging limits;
- template approval does not guarantee that a message is lawful, appropriate, deliverable, or accepted by a recipient;
- content and variables must remain consistent with the approved template and stated opt-in purpose; and
- Trouvaillesys may decline or stop messages that are likely to violate policy, harm quality ratings, or create legal or security risk.
9. Customer Data Handling and Deletion
The Client retains responsibility for the lawfulness, accuracy, and instructions associated with customer data it provides to the Service. Trouvaillesys will process customer data only to provide, secure, support, and administer the Service; comply with documented Client instructions; and meet applicable legal obligations, as further described in the Privacy Policy.
The Client must limit customer data to what is necessary for the permitted messaging purpose and must not provide sensitive or restricted information unless expressly agreed and legally permitted. The Client must use appropriate access controls and protect account credentials.
To request deletion of customer, account, Meta, or WhatsApp data held by Trouvaillesys, email admin@trouvaillesys.com or use the data deletion instructions. Include information sufficient for Trouvaillesys to identify the relevant account or business.
Trouvaillesys will process applicable deletion requests in accordance with its Privacy Policy and applicable legal requirements.
10. Account Security and Administration
The Client must keep credentials, tokens, devices, administrator access, and connected systems secure. The Client must promptly notify Trouvaillesys of suspected unauthorized access, compromise, or misuse. The Client is responsible for activity performed through its authorized accounts and users, except to the extent caused directly by Trouvaillesys.
11. Account Suspension and Termination
Trouvaillesys may restrict, suspend, or terminate the Service or affected messaging activity immediately when reasonably necessary, including for:
- actual or suspected violation of these Terms, law, or WhatsApp/Meta policies;
- missing or inadequate customer consent or opt-in evidence;
- spam complaints, poor quality ratings, excessive blocks, abuse, fraud, or security risk;
- nonpayment of applicable charges;
- conduct that may harm customers, Trouvaillesys, Meta, WhatsApp, or the messaging ecosystem; or
- suspension, restriction, or termination imposed by Meta, WhatsApp, a carrier, or another platform provider.
Where appropriate and permitted, Trouvaillesys will notify the Client and allow a reasonable opportunity to cure. Trouvaillesys cannot guarantee reversal of a restriction imposed by Meta or WhatsApp.
12. Service Availability and Third-Party Dependencies
The Service depends on networks, cloud providers, Meta, WhatsApp, carriers, and other third-party systems outside Trouvaillesys's control. Messages may be delayed, rejected, limited, or unavailable. Trouvaillesys does not guarantee uninterrupted operation, delivery, read status, conversion, or recipient response.
13. Disclaimers and Liability
To the maximum extent permitted by law, the Service is provided on an "as available" basis. Trouvaillesys disclaims implied warranties that cannot be expressly verified for a particular Client configuration. The Client remains responsible for its legal compliance, messaging decisions, content, consent, and customer relationships.
To the maximum extent permitted by law, Trouvaillesys will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by third-party platform action, message non-delivery, Client content, insufficient consent, or unauthorized Client account use. Any additional liability terms in an executed agreement take precedence over this section.
14. Changes to These Terms
Trouvaillesys may update these Terms to reflect changes in the Service, third-party platform requirements, pricing, or law. The updated Terms will be published on this page with a revised effective date. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.
